Our Terms and Conditions

The following terms and conditions apply to all transactionswith AV Promotions ltd. The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. Our existing Company terms and conditions still apply- available on request.

Pricing

The pricing on this website changes on a daily basis and we cannot guarantee the price until the item is purchased from the site. If you require pricing for promotions in the future, please contact the sales office directly.

Delivery

We process your order straight away in order to ensure prompt delivery using the selected delivery method. Delivery dates are however not guaranteed and time is not of the essence in relation to such dates. They are also subject to any matter beyond our reasonable control. We will use our reasonable endeavours to ensure delivery on the dates specified. All delivery charges will be added to the price of the products at our checkout. Mainland UK delivery charges quoted are for the majority of UK Mainland addresses. There are different delivery charges for the Channel Islands, Northern Ireland, Southern Ireland, Isle of Man, Scottish Highlands, Orkney Isles, Outer Hebrides and Shetland Isles.

Delivery Times

Delivery of products within mainland UK will normally be made within 1-5 working days. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes outside of our control. Any dates specified for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. If our suppliers or we are temporarily out of stock, we will notify you of this position and you should allow up to 14 days for dispatch of the goods. For delays of more than 14 days, you will have the right to cancel the order.


Signature

On receipt of goods by courier, the recipient is required to sign for the goods. Please note that when they sign, theyare signing for the parcel - received in good condition. If they are unable to check the contents of the package at that moment in time, please ask them to sign for the parcel as "UNCHECKED". Failure to do so may affect any claims that you make thereafter. It is their responsibility to sign for the correct number of packages as shown on the carrier's delivery consignment note. Failure to do so may affect any claims that you make therafter.


Time Limitation for Notification of Claims

Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 24 hours from delivery. It is also your responsibility to notify us of any in-correct goods supplied within 24 hours from delivery. We will not accept liability for goods lost in transit unless we are notified within 24 hours from the expected delivery date. If goods arrive in a visibly damaged condition, the recipient must refuse the consignment and make a note on the carrier's delivery consignment note. Once in receipt of goods andthey notice damage to the products, it will be your responsibility to inform us within 24 hours from delivery. Failure to do so may affect any claims that you make therafter.


Risk

As soon as we have delivered the goods to the recipients door, they will be responsible for them. Goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at the recipients own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery. We require every delivery to be signed "unchecked".

Price

The price of the products shall be as shown on our website at the date of the acceptance of the order.

We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. You will be informed of any increase in the price for the Products by Us and you will have the opportunity to cancel the Contract in relation to which the price increase has occurred. All prices on our website are exclusive of VAT, and subject to delivery charges which are indicated at the time of placing an order. We require a company purchase order for every order. Incorrect information will cause a delay in processing your order.


Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed.

Product Specifications

All the products we sell are of a technical nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter and specifications advertised on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturer's brochures or their websites. It is our intention to provide information on this website that is as accurate and up to date as possible. However, AV Promotions cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

Availability of Goods

All products and services are subject to availability and may be withdrawn at any time. We will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Property and Risk

Risk in the Products shall pass to the recipeint at the time of delivery. Delivery shall be deemed to occur at the time when the products arrive at the place of delivery.

We will retain title and ownership of the Products until we have received payment in full of all sums due and/or owing for all products supplied to you by us under this Contract.

From the time of receipted delivery of the Products, any loss or damage to the Products shall be at the recipient's own risk.

Guarantee

All Products are supplied with the manufacturers guarantee unless otherwise stated.

We guarantee that the Products will be free from defects in materials and/or workmanship for a period of 12 months (or longer if so required by law) from the date of delivery unless otherwise stated.

The guarantee in this clause above is given by us, subject to the following conditions:

  • We shall be under no liability in respect of any faults or defects caused by wilful damage, abnormal working conditions, failure to follow our instructions, misuse, alteration or repair of Products without our approval, improper maintenance or negligence on Your part or a third party. In addition routine maintenance (cleaning of dirty audio/video heads etc.), consumables (styli, plug fuses, cables, batteries, etc.), cosmetic damage and tuning of channels are not covered. This does not affect any statutory rights.

 

Repairs and Replacements

Where any defect in the Products is apparent upon inspection, we must be informedwithin 7 days of delivery.The recipientcan then, either, return the defective product to us directly or we will organise a collection fromtheir office /home at our own cost. Upon receipt of the Products and confirmation of the defect by technical engineers, you will be offered the following options:

 

  • - subject to availability, a replacement delivered to you free of charge; or
  • - a fullcredit provided the product has been verified defective and is complete with all accessories in its original box and packaging.

 

If the Product is not deemed to be defective by our technicians then You will be offered the following options: -

 

  • - the return of the Product tothe recipient. We will charge for the return andresend delivery; or
  • - a credit of the invoice cost less any applicable delivery charges provided that the Product is "as new" and complete with all accessories in its original box and packaging.

 

Liability

We shall have no liability for any matters which are outside Our control. We shall have no liability to you for defective Products, Products not dispatched or Products damaged or lost in transit unless the event is notified to Us within the appropriate time limit set out in this Contract. We shall have no liability for damage, loss, claims, costs or expenses caused or contributed to by Your continued use of defective Products after a defect has become apparent or suspected or should reasonably have become apparent to you.



We shall have no liability to your company for any:

 

  • - consequential losses;
  • - loss of profits and/or damage to goodwill;
  • - economic and/or similar losses;
  • - special damages and indirect losses; and/or
  • - business interruption, loss of business, contracts, opportunity and/or production.

If the previous clause applies, Our total liability to You shall not exceed the Contract price.

NOTHING IN THIS CONTRACT SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY DUE TO OUR NEGLIGENCE OR ANY LIABILITY WHICH IS DUE TO OUR FRAUD OR ANY OTHER LIABILITY WHICH IT IS NOT PERMITTED TO EXCLUDE AS A MATTER OF LAW. NOTHING IN THIS CONTRACT SHALL EXCLUDE OR LIMIT ANY OF YOUR STATUTORY RIGHTS WHICH MAY NOT BE EXCLUDED OR LIMITED DUE TO YOU ACTING AS A CONSUMER. ANY PROVISION WHICH WOULD BE VOID UNDER ANY CONSUMER PROTECTION LEGISLATION OR OTHER LEGISLATION SHALL TO THAT EXTENT, HAVE NO FORCE OR EFFECT.

We are committed to protecting your privacy and will only use the information that we collect from you lawfully (in accordance with the Data Protection Act 1998). Wewill not use your customers details for our own commercial purpose.

The personal information which we hold will be held securely in accordance with our internal security policy.

Faulty Goods within 28 days

Ifthe goods have arrived in a faulty condition or if the product develops a fault within 28 days of receipt, we will arrange for the goods to be collected by us. We will inspect the goods and once satisfied there is a fault, we will arrange for either a replacement product to be returned to the customer (subject to availability) or we will issue a you with a full credit. Faulty goods received back complete and as new in the original box, but the accessories are missing: then you will not be credited until these goods are also returned, or you will be charged for the missing products.

Goods received back incomplete, damaged or in a condition other than good; will be returned totherecipientand the cost of return carriage charged to your account.

We shall not be liable in respect of any faults or defects caused by wilful damage, abnormal working conditions, failure to follow our instructions, misuse, alteration or repair of Products.

Damaged inTransit (rejected)

In the event thatthe order is visibly damaged on delivery, the recipient MUSTNOT ACCEPT the delivery and they must enter on the courier consignment sheet "DAMAGED" along with a brief description on how or where the item has been damaged. The item will be returned to us and we will arrange for a replacement to be sent out.

Damaged inTransit (accepted)

If the recipient does happen to accept delivery of goods and discover they are damaged,THEY MUST NOTUSE THE GOODS, and this must be reported to us within 24 hours with a description of the damage, in as much detail as possible. You will waiver your right to a replacement ifthe damaged goods are used. All original packaging must be maintained. Any claims made after this time will be considered unreasonable and not accepted.

Goods Faulty in the Warranty Period

All Products are supplied with the manufacturers guarantee. If you are reporting faulty goods after the 28 days of receipt, the recipeint mustspeak to the manufacturer asthe warranty is with them.They will be entitled to a warranty repair, in some cases on site warranty is supplied or telephone help lines where they have all the information to hand.They would need to contact the warranty help lines to discussthe fault/repair. Please feel free to contact our customer services and we will be happy to provide you with the relevant manufacturers contact information.
